General terms
Article 1. General
These terms are relevant for all offers of cow-parade.be and for all agreements between CowParade, operating as 'cow-parade.be' (as mentioned from here on) and its (potential) customer ('customer' from here on). The customer is every natural or legal person in contact with cow-parade.be in order to purchase one or more of its products or services.
Except for other written agreements, the stipulations below apply. They are part of every offer and in case of acceptance of an offer they are integrally part of the agreement up to delivery. The acceptance of these terms without remarks of the customer and the conservation of an offer or the affirmation of an order apply as their consent. The fact that the customer did not receive the current general terms in his/her maternal language does not dismiss the customer of their implementation.
Should for any reason part of these general terms be no longer applicable, the remaining stipulations stay valid unabated. Cow-parade.be preserves the right to change its general terms without having to inform the customer personally and without the latter having the possibility to lay claim on a compensation.
Article 2. Offers and Agreements
All offers are informal, unless mentioned otherwise. In general all offers take place based on the tariffs on the moment of offering and are all VAT not included (unless mentioned otherwise). Agreements only come about after the customer placed his/her order and after acceptance of cow-parade.be
Every order that is placed by the customer to cow-parade.be, binds the customer irrevocably. The order implies the commitment of purchasing and settling the ordered products.
When cow-parade.be accepts the order, the customer will always receive an acknowledgment of the order. The acknowledgement of the order will contain by preference: the name of the cows, the number, the price, the delivery address, delivery rates and the presumable delivery time.
If between the moment of agreement and delivery an increase in price takes place that is beyond the control of cow-parade.be (increase of transport fees, insurance fees...), cow-parade.be preserves the right to charge the customer with this increase. The customer is informed of this in advance and has subsequently 2 working days to cancel his/her order.
Unless mentioned otherwise in the agreement, all additional deliveries and services are taken into account separately.
Article 3. Delivery and Terms of delivery
Cow-parade.be delivers worldwide.
Terms of delivery are always based on the information provided by De Post and are only used to give an indication, they do not count as exclusive terms of delivery. Exceeded terms of delivery – beyond the control of cow-parade.be – in no case give the customer the right to claim a compensation or reduction.
When cow-parade.be does not manage to deliver the ordered goods, due to the information provided by the customer, cow-parade.be will send the customer a letter of recommendation in order to summon him/her to collect the goods by courier within a given period of time. The customer will be charged with all warehouse costs.
Delivery of the goods by cow-parade.be always takes place on one address that should be accessible at all times.
Article 4. Shipping and transport
Cow-parade.be takes care of shipping of the goods which is at risk of the customer. Should a cow be delivered broken, the customer is held responsible for this. Of course it is possible to to come to a mutual understanding. The customer is charged with the shipping costs, which have been presented with the offer and which subsequently have been accepted with the order.
All goods will be well insured during transport by cow-parade.be
Article 5. Cases of force majeure and/or exceptional circumstances
Cow-parade.be is not bound to follow any commitment to the customer in case of impediments due to circumstances beyond its control. Such exceptional circumstances are strikes, disruptions in energy and/or material supply, delays in transport, delayed delivery of suppliers etc.
Article 6. Complaints
Cow-parade.be will severly examine all complaints and will try to come up with an acceptable solution for both parties within 10 working days. In case of complaints, the customer needs to take into account:
At reception the customer should check the goods thoroughly for faults and defects and report these immediately to info@cowparade.be. When after 48 hours no remarks have been reported, the goods are seen to be in good shape and in conformity with the order.

USER AGREEMENT
Article 1. Object
This user agreement contains the stipulations and conditions applicable on the use of information and services offered. The user of the web site and the services/products offered on the site is thought to have given his/her consent on the stipulations of this user agreement. Cow-parade.be preserves the right to change at all time this user agreement, as well as all other terms and conditions presented on the web site. The modified user agreement, terms and conditions will be made public on the site of cow-parade.be and will apply 30 days after the first publishing on the web site.
Article 2. Internet communication platform
Cow-parade.be is an internet communication platform where offers are presented.
Article 3. Responsibility
Cow-parade.be cannot be held responsible for inaccuracies or shortcomings in the data mentioned on the web site. This also applies for information put on the site by cow-parade.be as well as information provided by its users.
Incorrect data or shortcomings on the cow-parade.be site do not give any right on a financial compensation. Cow-parade.be is not responsible for any suffered direct, indirect or accidental damage, loss of profit or whatever caused damage to its users or third parties caused by its negligence or forgetfulness in providing, compiling, assembling, writing and interpreting information.
Cow-parade.be explicitly offers its web site 'as it is'. For its technical realisation the most advanced techniques are used. Nevertheless, cow-parade.be cannot be held responsible for the (temporal and possible) malfunctioning of the system.
Cow-parade.be is not responsible for links referring to web sites that are run by third parties. Cow-parade.be does not controle any of these web sites and subsequently does not accept any responsibility for their content. The registration of these links does not imply that cow-parade.be approves all elements on these web sites and does not necessarily imply a co-operation between cow-parade.be and the owners of these web sites.
The information on the web site is changed periodical. Cow-parade.be preserves the right to carry through improvements and/or changes to the web site at any given moment, including the terms of delivery and prices. Prices, quantities and terms of delivery of the offered goods depend on the number of ordered quantities and on the quantity put available by the artist.
Article 4. Intellectual property and copyright
The user acknowledges explicitly that the provided data on the web site (texts, graphical elements...) are and stay property of cow-parade.be and its respective owners.
Nothing from the site is allowed be used for reproduction, adaptation, distribution, sales, publication or commercial objectives without preceding written permission of cow-parade.be. It is also forbidden to save this information electronically or to use it for illegal objectives. The saving of information provided on the cow-parade.be site is not allowed in a database, with exception to the automatically 'caching' of information by your browser.
Article 5. Privacy regulation and protection of the personal atmosphere
Cow-parade.be collects personal information which is necessary to guarantee an optimal operation of the site, to further optimise our service offer or to offer the user personalized services. Cow-parade.be can use this information for commercial actions and/or messages. Cow-parade.be binds itself never to provide these data to a third party without the explicit permission of the person involved.
Cow-parade.be also collects information in log files. This information is used for internal objectives, such as a traffic and profile analysis in order to further optimise the offer of services on the web site. Cow-parade.be may make use of 'cookies' (little pieces of information saved on the hard disk in order to simplify the use of the web site). Changes to the Privacy Regulation of cow-parade.be are possible at all times but will be informed to the user through the web site.
In accordance with the law of 8 December 1992 for the protection of the personal atmosphere, all data filled out on our site by the user is reported on request and is, if the user wishes this, corrected for free within a reasonable period of time. Article 6. Proof and Applied Jurisdiction
The Belgian jurisdiction is applied. Both parties acknowledge that their electronical communication is of legal value as written evidence. In case of dispute or disagreement only the court of Bruges is authorized.
